His oldest child, Ann (my husbands's great grandmother) according to the family was born "On the shores of Lake Ontario" in New York. Virginia ... while engaged in actual service in said battle ... on the 31st of May, 1862... That said Benjamin Franklin Loop left neither widow, nor any children and was then single and unmarried, nor father nor mother. That at the time of his death he left surviving him, a sister by the name of Ann Loop (now Ann Wickes) now living, a sister by the name of Jane Morris (formerly Jane Loop), Eugene C. Loop, a brother, who died five years since, Jennette P. Reed, now living, a sister, and this applicant. That each of said sisters and brothers were the issue of the parents of said soldier, the order of their birth being as herein stated. Ann Wicks child of Amos Loop and Cynthia Loop, born March 11th, 1830; Jane Morris child of the same parents born; Eugene C. Loop a child of the same parents born March 21st 1835, died; Jennette P. Reed a child of the same parents born Feb 6th, 1840; Harriet Atwood Sampson, this applicant, a child of the same parents born March 17th 1842; [this stuck in later] Jane P. This applicant further says that at the time of the death of said Benjamin Franklin Loop she was partially dependent on [him] for support and that no pension has ever been received ... That said parents were married under the name of Amos Loop and Cynthia Peck, ... there being legal barrier to their marriage; That none of the said brothers or sisters or this applicant has aided or abetted tha rebellion; ... This applicant further says that none of the other brothers or sisters were ever dependent for support on said Benjamin Franklin Loop. Attorney's notes: Can prove the following facts: (1) That Benj. F. Loop's purported parents lived here for more than 20 years before his death as husband and wife, they having removed from the state of New York and that Benjamin was born here while they were living together as husband and wife. He lived with them till their death. No certificate of marriage or record can be found, no record from N.Y. can be obtained as no records of marriage were then kept there according to the clerk of Oneida Co., where they were married _?_ (now Utica Co. N.Y.). (2) The father died in 184? can prove this by positive testimony. (3) The mother died in Indiana at Warsaw in 1857. We can prove her death by general _?_, obituary notices and administration of estate here. (4) Benj. Loop went into the army and was killed at the Battle of Fair Oaks or of Pines in 1862. He received no bounty or pension. (5) He left a sister, the applicant, who was feeble and had relied on him for support. We can show that he sent her money home from the army by his comrades... She had no property except about $70 which she got from her mother's estate... She was married in 1866. The soldier left no widow or children ... From John Whitman Descendants, p. 496: 7250 James D.
